Abstract

enStarting from the annulment of the presidential elections in December 2024 by the Constitutional Court of Romania, this paper aims to examine the rule of law in Romania and its evolution from a diachronic perspective since 1989. The evolution of the rule of law is strongly influenced by the European Union accession in 2007, coinciding with the application of a monitoring mechanism called the Cooperation and Verification Mechanism, between 2007 and 2022. The factors that contributed to the evolution of the rule of law, the political context, and the interaction between the Constitutional Court of Romania and the Court of Justice of the European Union will be analyzed. Finally, the case study will provide an overview of recent events in Romania, in order to explain the significance of the annulment of the presidential elections from the perspective of the rule of law, following the formal conclusion of the Cooperation and Verification Mechanism.
