Abstract

This thesis analyzes the international legal framework on genocide, specifically the elements of genocide under Article II of the 1948 Convention on the Prevention and Punishment of the Crime of Genocide, and applies the law on genocide to the situation in the Middle East. It argues that the atrocities taking place in Syria and Iraq meet the definition of genocide under international law, and that States therefore have an obligation to act. It outlines the responsibility of States, and lastly discusses the further action that should be taken by States within the international legal framework to secure justice for the victims, as well as prevent and prosecute acts of genocide.
