Abstract

This paper’s objective is one generally aiming toward the understanding of the place allocated to virginity in law. Both chapters will humbly attempt to provide an accurate depiction of the complex ways in which virginity exists in legal frameworks. Eventually, this paper will attempt to understand whether virginity is or can be accepted as a legal concept on its own. Specifically, this paper will focus on virginity and its testings. To do so, the legitimacy of hymen examination in our modern society will be questioned. In other words, through thorough legal analysis, this paper will, address virginity tests to understand if they are to be accepted as part of modern judicial systems. Through a multidisciplinary perspective with religion at the epicenter of debate, worldwide legislation and doctrinal discussions will be used as comparative tools.
